| Mr J, an Afghan National, arrived in the UK in 2001. He made an application for asylum, which was refused, and he had exhausted all his appeal rights. He instructed our firm and we advised him that he could lodge an application for an EEA Resident Card, as he was in durable relationship with a Slovakian National; she was a worker therefore a person exercising Treaty Rights in the UK. We made an application for Mr J together with his partner. Due to the change in Law we further advised Mr J that he could apply for a Certificate of Approval (COA) and get married in the UK. We made a successful application for a COA. Mr J then registered his marriage with his partner. We made further representations to the UK Border Agency on his behalf and succeeded in obtaining a five-year Residence Card. Mr J currently lives in Birmingham with his wife and has been able to visit his family in Afghanistan after 8 years.
